Jose Espinoza is charged with manslaughter in the death of his son Isaiah in a vehicle rollover two years ago.

Jose Nicasio Espinoza of Maricopa, charged with manslaughter in the death of his 6-year-old son Isaiah, went before Superior Court Judge Joseph Georgini on Tuesday in his latest hearing.

The judge set a pretrial hearing for Dec. 1 at 1:30 p.m. The jury trial is scheduled to begin Feb. 22.

Espinoza, now 27, was driving a Toyota truck on Sept. 20, 2013, when he lost control on Ralston Road. The vehicle rolled several times.

According to the Pinal County Sheriff’s Office, neither Jose nor Isaiah Espinoza was wearing a seatbelt at the time of the crash and both were ejected from the truck. Jose Espinoza’s injuries were non-life-threatening, but Isaiah was pronounced dead at Maricopa Medical Center in Phoenix.

Isaiah was a first-grader at Maricopa Elementary School.

Espinoza was accused of being under the influence of alcohol or marijuana. He was indicted by a grand jury on Sept. 3, 2014.
