Agreement to use MUSD playing fields on Tuesday’s agenda

The city council will discuss and possibly take action on an agreement between the city and the Maricopa Unified School District to allow the public use of middle school playing fields during non-school hours.

The agreement was approved by the MUSD Governing Board last week at its regular meeting.

If the city approves the intergovernmental agreement, it will be the final step in discussions that began between the city and school district in spring of 2010.

In December, the plan revolved around a proposal in which the Maricopa Unified School District would open the Maricopa Wells Middle School and Desert Winds Middle School playing fields to public use. The schools have facilities for football, soccer, baseball and softball.

The purpose of the agreement is to allow public usage of the middle school fields just as if they were city parks. When school is not is session, the city will manage all maintenance, general repairs, water costs and scheduling of field usage. The city will be responsible for the oversight of the activity and city park rules will be in effect.

Funding to implement this agreement will be brought before council at a future meeting.
The agreement does not address arrangements for access to restroom facilities or additional lighting.

3.3 The Mayor and City Council shall hear a presentation by Development Services Director Brent Billingsley detailing the alternative development and alternative evaluation process for the White & Parker/Maricopa-Casa Grande Highway Grade Separation Major Investment Study.

3.4 The Mayor and City Council shall hear a presentation from Development Services Director Brent Billingsley, providing an update on the North Santa Cruz Wash Regional Solution engineering effort and ongoing negotiations toward a development agreement with property owners adjacent to the planned North Santa Cruz Wash channel.

4.0 Executive Session

4.1 The Maricopa City Council may go into executive session for purpose of obtaining legal advice from the City’s attorney and to consider its position and instruct representatives regarding negotiations for the purchase, sale or lease of real property pursuant to A.R.S. § 38-431.03 (A)(3) and (A)(7).

4.2 The Maricopa City Council may go into executive session for the purpose of discussion or consultation with the City’s attorney to consider its options and instruct representatives regarding the Ak-Chin Indian Community’s Fee-to-Trust Applications with the Federal Government which includes properties within and near the City of Maricopa pursuant to A.R.S. §38-431.03 (A)(3).

4.3 The Maricopa City Council may go into executive session for the purpose of obtaining legal advice and discussion or consultation with the City Attorney to consider its position and instruct its attorney regarding the public body’s position regarding an annexation and possibly entering into a Pre-annexation and Development Agreement with one or more landowners in the annexation area and the potential terms thereof to facilitate such annexation, pursuant to A.R.S. §38-431.03(A)(3) and (A)(4).

4.4 The Maricopa City Council may go into executive session for the purpose of discussion or consultation with the City’s attorney to consider its position and instruct representatives regarding the pending claims and lawsuits filed against the City pursuant to A.R.S. § 38-431.03 (A)(3) and (4).

7.0 Public Hearings

7.1 The Mayor and City Council shall hear public comment on a request by Shaw and Associates on behalf of Verizon Wireless who is requesting approval of a Conditional Use Permit (CUP) for a proposed cellular tower. The tower is located at 44705 W. Canyon Creek Dr. generally located a quarter (¼) mile west of John Wayne Pkwy and one 1 mile north of Smith Enke Rd. The property is zoned General Rural (GR) Agriculture use.

9.5 Industrial Development Authority. The Mayor and City Council shall discuss and possibly take action on a request by Economic Development Director Danielle Casey on the re-appointment of up to five (5) members of the board of directors of the Industrial Development Authority of the City of Maricopa, in accordance with term limits of the seats available, as well as ARS 35-705. Discussion and Action.

9.8 Intergovernmental Agreement. The Mayor and City Council shall discuss and possibly take action on a request by Intergovernmental Manager to approve a Playing Fields Intergovernmental Agreement (IGA) between the City of Maricopa and Maricopa Unified School District for the purpose of allowing public use of middle school playing fields during non-school hours. No budgetary impact: Funding to implement this agreement will be brought before council at a future Council meeting. Discussion and Action.
9.9 Memorandum of Understanding. The Mayor and City Council shall discuss and possibly take action on the adoption of a Third Amendment and Restatement to the Memorandum of Understanding with the Professional Firefighters of Maricopa IAFF Local 4561. Discussion and Action.

9.10 Resolution 11-54. A Resolution of the Mayor and City Council of the City of Maricopa, Arizona, declaring as a public record that certain document filed with the City Clerk and entitled "Meet and Confer Code effective October 1, 2011," relating to the establishment of a Meet and Confer process for City employees and amending the Maricopa City Code by amending Section 3-278, 3-280 and 3-281 of the previously adopted City Code. Discussion and Action.
9.11 Ordinance 11-09. An Ordinance of the Mayor and City Council of the City of Maricopa, Arizona, adopting "Meet and Confer Code effective October 1, 2011" by reference which amends sections 3-278, 3-280 and 3-281 of the Maricopa City Code and providing for severability and the effective date thereof. Discussion and Action.

9.12 Approval of Contract. The Mayor and City Council shall discuss and possibly take action on a request by Transportation Manager Chris Salas to approve an Award of Contract for on-call geotechnical services to Ninyo & Moore, in an amount not to exceed $200,000.00, for multiple future projects, both known and to be determined. Based on the various projects that will require these services, funding sources and specific line items will be addressed on a case-by-case basis. This Award of Contract is in compliance with City of Maricopa, Purchasing Code, Article IV, Section 3-215 "Bidding Procedures." Discussion and Action.

9.13 Approval of Contract. The Mayor and City Council shall discuss and possibly take action on a request by Transportation Manager Chris Salas to approve an Award of Contract for on-call geotechnical services to AMEC Earth and Environmental, Inc., in an amount not to exceed $200,000.00, for multiple future projects, both known and to be determined. Based on the various projects that will require these services, funding sources and specific line items will be addressed on a case-by-case basis. This Award of Contract is in compliance with City of Maricopa, Purchasing Code, Article IV, Section 3-215 "Bidding Procedures." Discussion and Action.

The Mayor and City Council shall discuss and possibly take action on a request by Intergovernmental Manager Paul Jepson to approve a contract with Nexxus Consulting L.L.C. for consulting services in an amount not to exceed $96,000.00 to be paid from budget line item General Fund, Mayor and Council, Professional and Occupational Services, (10011111-53320) Discussion and Action.

9.17 Resolution 11-55. A Resolution of the Mayor and City Council or Maricopa, Arizona, recommending that the Arizona Independent Redistricting Commission (IRC) consider certain general concepts proposed by the Maricopa City Council in its deliberation as it works to draw the new Congressional and Legislative boundaries for the State of Arizona. Discussion and Action.

9.18 Approval of Contract. The Mayor and City Council shall discuss and possibly take action on a request by Assistant Police Chief Kirk Fitch to approve contract with Universal Police Supply in an amount not to exceed $46,650 to be paid from the General Fund, Police Uniform, Uniforms (10022122-55650) for the option to purchase police department uniforms. This Award of Contract is in compliance with City of Maricopa, Purchasing Code, Article IV, Section 3-215 "Bidding Procedures." Discussion and Action.
