Public park alcohol consumption policy and special events top council agenda for Tuesday

The Maricopa City Council will meet Tuesday to set public policy for alcohol consumption in public parks and to approve two special events, a Founders Day classic car show and display and the Holiday Homes on Parade. Public hearings on annexation and zoning for the Avalea development will be held. The work session begins at 6:30 rather than 6 p.m., and both agendas follow:

4.3 Liquor License Application: Brooklyn Boys Pizzeria & Restaurant. The City Council shall discuss consideration of recommendation to the Arizona State Liquor Board for a Liquor License application submitted by Lauren Merrett, on behalf of Brooklyn Boys Pizzeria & Restaurant, located at 20800 N. John Wayne Parkway. Discussion.

City of Maricopa lawsuit.

4.1 Annexation 06.01: Annexation 06-01 Legal description of the territory proposed to be annexed, not already within the present limits of the City of Maricopa and located in Pinal County, Arizona, is as follows: Those portions of Sections 1 and 12 of Township 5 South, Range 3 East and all of Sections 2,3 and 11 of Township 5 South, Range 3 East of the Gila and Salt River Base Meridian, Pinal County, Arizona, described as follows: All of Section 2, township 5 South, Range 3 East of the Gila and Salt River Base Meridian , Pinal County, Arizona. All of Section 3, Township 5 South, Range 3 East of the Gila and Salt River Base Meridian, Pinal County, Arizona. All of Section 11, Township 5 South, Range 3 East of the Gila and Salt River Base Meridian, Pinal County, Arizona. The West ½ of section 12, Township 5 South Range 3 East; except 5.00 acres in the East 1/2, South West ¼ of the Gila and Salt River Base Meridian, Pinal County, Arizona. All portions south of the City of Maricopa Incorporated Limits within Section 1,Township 5 South, Range 3 East of the Gila and Salt River Base Meridian, Pinal County Arizona. The Petition for this annexation was filed on March 14, 2006, Official Records of Pinal County Recorder.

4.2 PAD05.15 and ZON05.14: A request by Shea Homes I, L.L.C.; Fulton Homes Corp.; Standard Pacific Homes, Inc., Pantano II L.L.C. and SM Investments, Inc., for approval for the development of approx. 2,179 acres to be established as a residential Master Planned Development known as Avalea located within Pinal County. The applicant is requesting to rezone this property from CR-1, CR-2, CR-3, CR-4, CB-1, CB-2 SR, PAD Overlay to CR-2, CR-3 (Single Family Residential), CR-4 (Multiple Residential), CR-5 (Multiple Residential), TR (Transitional Zoning) and CB-2 (Commercial) and SR (Golf Course) PAD. This zoning is to allow for a variety of uses including; residential, commercial, mixed use, school, and open space. An application has been made to the City of Maricopa, and an annexation petition has been filed with Pinal County to include this development within the City of Maricopa corporate limits. This development is located in Township 5 South, Range 3 East, Sections 2, 3, 11, and a portion of Section 12 in Pinal County, Arizona. The property is generally bounded by John Wayne Parkway (SR 347) on the West, Peters and Nall Road on the South, Porter Road along Northeast half, and ½ mile West of White and Parker Road and Farrell Road to the North.

5.6 Special Event Permit: Holiday Homes on Parade. The City Council shall discuss and possibly take action on a request by PRL Director Martin McDonald to conduct a special event known as Holiday Homes on Parade. Discussion & Action.

5.7 Ordinance 06-09. An Ordinance of the Mayor and City Council of the City of Maricopa, extending and increasing the corporate limits of the City of Maricopa, Pinal County, State of Arizona, pursuant to the provisions of Title 9, Chapter 4, Article 7 Arizona Revised Statutes and amendments thereto, by annexing thereto certain territory contiguous to the existing city limits of the City of Maricopa, consisting of 2, 615 acres, more or less, located in portions of sections 1 and 12 of Township 5 South, Range 3 East and in all of sections 2, 3 and 11 of Township 5 South, Range 3 East of the Gila and Salt River Base and Meridian, Pinal County, Arizona, to that of the legal limits of the Ak-Chin Reservation, not currently within the corporate limits of the City of Maricopa, Pinal County, Arizona, known as annexation petition 06-01. Discussion & Action.

5.8 Ordinance 06-10. An Ordinance of the Mayor and City Council of the City of Maricopa, Arizona, zoning certain property described in zoning case ZON 05.14 and PAD 05.15 for the development of approximately 2, 179 acres generally bounded by John Wayne Parkway on the west, Peters and Nall Road on the south, Porter Road along the northeast half and one-half mile west of White and Parker Road and Farrell Road to the North. The parcels of land are situated in sections 2, 3, 11 and a portion of section 12 of Township 5 South, Range 3 East of the Gila and Salt River Base and meridian, Pinal County, Arizona which is known as Avalea. 5.9 Ordinance 06-11. An Ordinance of the Mayor and City Council of the City of Maricopa, Arizona, repealing Ordinance 06-09. Discussion & Action.

5.10 Development Agreement Term Sheet with Engle Homes. The City Council shall discuss and take action upon a term sheet for a development agreement with Engle Homes that would address all outstanding issues concerning the development of the Province subdivision, including resolution of the Home Builders Assoc v. The procedures to follow if you address the Council are: Council requests that you express your ideas in five minutes or less and refrain from any personal attacks or derogatory statements about any City employee, a fellow citizen, or anyone else, whether in the audience or not. The Mayor will limit discussion whenever he deems such an action appropriate to the proper conduct of the meeting. At the conclusion of an open call to the public, individual members of the Council may respond to criticism made by those who have addressed the Council, may ask Staff to review a matter, or may ask that a matter be put on a future agenda. However, members of the Council shall not discuss or take legal action on any matters during an open call to the public unless the matters are properly noticed for discussion and legal action.
