Bill Sims, an attorney with the law firm Sims & Murray who investigated the workplace complaint filed against Councilman Alan Marchione, will present recommendations based on a report of his findings to the Maricopa City Council Tuesday.

The item was a late-afternoon addition Monday to the council’s agenda for its regular 7 p.m. session. City Clerk Vanessa Bueras confirmed the presentation was on the complaint facing Marchione.

Marchione, returning a call for comment early Tuesday morning, said he could not comment on the report because he said it was still a confidential document.

However, he did emphasize that “I have cooperated fully with this investigation” and said “the factual findings of the report will speak for themselves.”

“Those in the community who know me know that I'm a good man,” Marchione said.

Another reason the councilman said he didn’t comment during the investigation is because, “I think it’s important when there’s an independent investigation, that it remain independent.”

Marchione also said he was looking forward to the whole incident being put behind the city because “there are so many other important projects the city is working on.”

The council will hold an executive session prior to its regularly scheduled work session at 5 p.m. to obtain “legal advice from the city’s attorney and Attorney Bill Sims regarding the status of an investigation concerning a work environment complaint and give direction on how to proceed,” according to the executive session agenda.

The details of the complaint are unknown, and Marchione’s attorney advised him not to comment on the matter.
