A Maricopa man is facing multiple drug charges after he was arrested earlier this month.

David Gutierrez, 30, is charged with possession of narcotics, aggravated DUI on a suspended license and possession of drug paraphernalia, police said.

Around 10 a.m. on Sept. 3, a resident called police to report a man smoking drugs in his vehicle at West Robbins Drive and North Danielle Avenue in Homestead. When police arrived, the vehicle was idling at a stop sign. Officers approached the vehicle and detected an odor of burning chemicals, police said.

Police had the occupant, identified as Gutierrez, step out and questioned him about what he was smoking. Gutierrez allegedly admitted to smoking two Percocet pills and stated he had more in his car, police said.

Upon searching the vehicle, officers found foil sheets – commonly used to smoke opiate pills – on the passenger side floor, a straw and four additional Percocet pills, according to the police report. When it ran Gutierrez’s license, police dispatch notified officers of three suspensions for failure to appear in court.

Gutierrez was placed under arrest and booked into Pinal County Jail. He has since been released, according to online jail records.

If found guilty, he would face a minimum of 18 months in prison, according to state statute.
