Approval of interim chief’s contract on council agenda

The Maricopa City Council will hear and possibly take action tomorrow on a request by City Manager Fischer to approve a professional services contract with the city of Mesa for Steven Stahl to serve as interim police chief of Maricopa.

Stahl began as interim chief today to replace retiring Police Chief Patrick Melvin. He is on loan from the Mesa Police Department, and comes to Maricopa through an intergovernmental agreement with Mesa. Stahl will serve until a permanent chief is recruited, which is expected to take until July.

Stahl’s temporary position with Maricopa will be funded from the General Fund Police Administration in the amount not to exceed $200,000 per year as reimbursement for his salary and benefits paid by the city of Mesa.
Stahl’s services require that Maricopa reimburse Mesa for his current salary and benefits, plus a 15 percent assignment bonus, for the duration of his assignment in Maricopa. The incremental cost of this contract is anticipated to be approximately $134,000 through the end of the fiscal year (June 30).

Stahl brings more than 24 years of experience in various leadership roles with the Mesa Police Department. During his service to the citizens of Mesa he has overseen the city’s crime lab, jail, two patrol districts, Special Operations Unit, the Gang Unit, Swat Team and Communications.

4.1 The Maricopa City Council may go into executive session for purpose of obtaining legal advice from the City’s attorney and to consider its position and instruct representatives regarding negotiations for the purchase, sale or lease of real property pursuant to A.R.S. § 38-431.03 (A)(3) and (A)(7).

4.2 The Maricopa City Council may go into executive session for the purpose of discussion or consultation with the City’s attorney to consider its options and instruct representatives regarding the Ak-Chin Indian Community’s Fee-to-Trust Applications with the Federal Government which includes properties within and near the City of Maricopa pursuant to A.R.S. §38-431.03 (A)(3).

4.3 The Maricopa City Council may go into executive session for the purpose of obtaining legal advice and discussion or consultation with the City Attorney to consider its position and instruct its attorney regarding the public body’s position regarding an annexation and possibly entering into a Pre-annexation and Development Agreement with one or more landowners in the annexation area and the potential terms thereof to facilitate such annexation, pursuant to A.R.S. §38-431.03(A)(3) and (A)(4).

4.4 The Maricopa City Council may go into executive session for the purpose of discussion or consultation with the City’s attorney to consider its position and instruct representatives regarding the pending claims and lawsuits filed against the City pursuant to A.R.S. § 38-431.03 (A)(3) and (4).

8.0 Consent Agenda All items on the Consent Agenda are considered to be routine matters and will be enacted by one motion of the Council. 8.1 Resolution 11-60. A Resolution of the Mayor and City Council of the City of Maricopa, Arizona, approving that certain document entitled "Rules for Procedure (By-Laws) for the Maricopa Board of Adjustment." Discussion and Action.

8.2 Resolution 11-61. A Resolution of the Mayor and City Council of the City of Maricopa, Arizona approving formal adoption of the Pinal County Transit Feasibility Study and approving the City’s continued support of Regional Transit Planning efforts consistent with the study. Discussion and Action.

9.1 Presentation. The Mayor and City Council shall hear a presentation by Intergovernmental Manager Paul Jepson introducing Operation Welcome Home in honor of returning veterans to Maricopa. Discussion.

9.2 IDA Board. The Mayor and City Council shall hear a presentation and possibly take action on a request by the Industrial Development Authority Board regarding their annual plan of activities and a proposed budget, requesting funding in the amount of $2,500 requiring a transfer from 10010000-99000 (contingency) to 10011616-55540 (economic development advertising). Discussion and Action.

9.3 Shop Maricopa. The Mayor and City Council shall discuss and possibly take action on a request by Economic Development Director Danielle Casey to re-authorize an annual event, Shop Maricopa, to assist in promoting local business awareness and economic growth from November 18, 2011 to January 6, 2012. Discussion and Action.

9.4 Award of Contract. The Mayor and City Council shall discuss and possibly take action on a request by Development Expeditor Brad Hinton to approve an Award of Contract to JNC Landscaping, LLC for landscape maintenance services at three separate locations: Within the right-of-way of Maricopa-Casa Grande Highway at The Wells shopping center, the Maricopa Wells Junior High School, and Desert Wind Junior High School fields. This Award of Contract, in an amount not to exceed $30,360 per year, is recommended to be awarded to JNC Landscaping, LLC. The award will be funded from Highway User Revenue Fund, Public Works, Repair and Maintenance (20055151-54430) in an amount not to exceed $12,420 per year; and General Fund, Recreation, Lawn Care (10033131-54424) in an amount not to exceed $17,940 per year. This Award of Contract is based on the lowest responsible bidder pursuant to City of Maricopa Purchasing Code, Section 3-4-7. Discussion and Action.

9.5 Consent to Apply for Grant. The Mayor and City Council shall discuss and possibly take action on a request by Transportation Manager, Chris Salas and Grants Manager, Mary Witkofski to submit an application to the Arizona Department of Transportation’s Section 5311 – Rural Transit grant for the operation of transit for the City of Maricopa. Consent will be to submit an application and includes completion of all necessary paperwork for the application process and designates the City Manager to sign all necessary paperwork and contracts/IGA if grant is awarded. The City of Maricopa Transportation Department will need to provide a financial match of through the General Fund, Transportation, Technical Fund (100-44146-53340). Discussion and Action.

9.6 Approval of Agreement. The Mayor and City Council shall discuss and possibly take action on a request by Development Services Director, Brent Billingsley to approve a Preliminary Plat Extension Agreement for the Cortona Subdivision. Discussion and Action.

9.7 Presentation. The Mayor and City Council shall hear a presentation from staff on a public-private partnership for the City owned Estrella Gin property and provide direction to staff on how to proceed. Discussion.
